It's like passing on a book or photocopying it and keeping the original. The first is fine - the second is against the law.

what about swqapping for a legally obtained mp3 that the giver does not keep a copy of?

The live mp3 I have bought is not the right version and the single on iTunes is less than a minute long which I didn't realize until after I bought it. As I have stated, I would be willing to trade something in return for the Can Can 7" version.
